Velvr — Acceptable Use Policy (AUP)

Velvr Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of the Velvr Agreement between MAKOA LLC (operating Velvr) and you, the Customer. By accessing or using the Service, you agree to comply with this AUP. Violations may result in immediate account suspension, termination, and other remedies.


1. General Principles

You agree to use the Service:

  • In compliance with all applicable laws, regulations, and third-party platform terms (especially Fanvue's Acceptable Use Policy and Community Guidelines);
  • With respect for the rights, privacy, and dignity of fans and other users;
  • In good faith and consistent with the legitimate operation of an adult content creator business;
  • With awareness that you remain solely responsible for all content sent under your persona identity, including content generated by the AI Auto-Reply Feature.

2. Prohibited Conduct

You shall NOT use the Service to engage in any of the following activities:

2.1 Content Involving Minors (Strictly Prohibited)

(a) Create, host, transmit, simulate, suggest, or roleplay any content involving minors (persons under 18) in any sexual, suggestive, or exploitative context; (b) Create or maintain personas that depict, simulate, or could reasonably be interpreted as depicting minors; (c) Configure persona descriptions, hard limits, or AI behavior in a way that could enable, encourage, or simulate sexual roleplay with characters who are minors or appear to be minors; (d) Engage in any conduct that violates 18 U.S.C. §2251–2260 (federal child exploitation statutes), CSAM laws, or analogous laws in any applicable jurisdiction.

Velvr's Hard Limits validator (Layer 5) actively scans for and blocks content matching minor-related patterns. Any violation is grounds for immediate, permanent termination plus reporting to law enforcement and the National Center for Missing & Exploited Children (NCMEC) as required by law.

2.2 Impersonation and Misrepresentation

(a) Create personas that purport to be specific real, identifiable persons without their explicit written consent; (b) Use the Service to impersonate Velvr employees, support staff, law enforcement, or other officials; (c) Misrepresent your identity, age, or eligibility to use the Service or any connected third-party platform; (d) Create personas designed to defraud, deceive, or manipulate fans for unlawful purposes.

2.3 Off-Platform Payment Solicitation

(a) Use the Service to direct fans toward payment methods, services, or platforms outside Fanvue (or another authorized connected platform); (b) Configure AI replies to suggest, offer, or hint at off-platform payment arrangements (Cashapp, Venmo, crypto, bank transfer, etc.); (c) Velvr's Hard Limits validator (Layer 5) actively blocks such content. Repeated violations indicate misuse and grounds for termination.

2.4 IRL (In-Real-Life) Meeting Solicitation

(a) Use the Service to suggest, offer, agree to, or arrange in-person meetings between personas and fans; (b) Configure AI replies to indicate willingness for IRL contact; (c) Velvr's Hard Limits validator (Layer 5) actively blocks such content.

2.5 Phone, Video Call, and Direct Contact Outside the Platform

(a) Use the Service to solicit phone calls, video calls (FaceTime, Zoom, Skype, etc.), or direct contact (SMS, WhatsApp, Telegram, etc.) between personas and fans; (b) Provide or solicit personal contact information through AI replies; (c) Velvr's Hard Limits validator (Layer 5) blocks such content.

2.6 Coercion, Threats, and Abuse

(a) Use the Service to harass, threaten, coerce, blackmail, or abuse fans or other users; (b) Engage in any form of stalking, intimidation, or unwelcome contact; (c) Use AI replies to create false urgency, exploit emotional vulnerability, or manipulate fans into actions against their interest; (d) Manipulate persons in vulnerable situations (mental health crises, substance abuse, financial distress, etc.).

2.7 Fraud and Deception

(a) Use the Service to defraud fans, including but not limited to: false promises of content delivery, false scarcity, fake testimonials, false identity claims about real persons; (b) Engage in chargeback fraud, payment evasion, or any scheme to circumvent Fanvue's payment infrastructure; (c) Use the Service to operate any form of pyramid scheme, multi-level marketing, or similar arrangement.

2.8 Non-Consensual Content

(a) Upload, transmit, or process any content created without the explicit consent of all depicted persons; (b) Use the Service to create deepfakes or AI-modified imagery of real persons without their consent; (c) Solicit or facilitate the creation, sharing, or distribution of non-consensual intimate imagery (NCII).

2.9 Illegal Content and Activities

(a) Use the Service in furtherance of any illegal activity under federal, state, or local U.S. law; (b) Process, transmit, or store content that violates intellectual property rights, including copyrighted material without license; (c) Engage in human trafficking, sex trafficking, or any activity prohibited by 18 U.S.C. §1591, the Mann Act, or analogous statutes; (d) Use the Service to facilitate prostitution outside lawful jurisdictions or to circumvent FOSTA-SESTA restrictions.

2.10 Platform Abuse

(a) Bypass, disable, or circumvent any security or access-control feature of the Service or any connected third-party platform; (b) Reverse engineer, decompile, or disassemble the Service software; (c) Engage in API abuse, including exceeding documented rate limits, scraping data, or unauthorized data extraction; (d) Operate the Service in a manner that materially threatens its availability, performance, or security for other Customers; (e) Use the Service to introduce malicious code (viruses, malware, worms, ransomware, etc.).

2.11 Multiple Accounts and Referral Fraud

(a) Create multiple accounts to circumvent Service limits, free trials, or referral programs; (b) Engage in self-referral schemes or use third parties to simulate independent referrals; (c) Resell, sublicense, or share your Service access with unauthorized parties.

2.12 Discrimination and Hateful Conduct

(a) Use the Service to create content or personas that promote, glorify, or facilitate violence, discrimination, or hatred against protected groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics; (b) Create harassment campaigns targeting specific individuals or groups.


3. Persona-Specific Constraints

When configuring AI personas through the Service:

3.1 Adult-Only Personas. All personas must be configured as adults (age 18+). The Service does not permit configuration of minor or apparent-minor personas.

3.2 Honest Constraints. Persona descriptions should reflect the intended creative direction. Configurations designed to circumvent Velvr's Hard Limits validator (Layer 5) constitute a violation of this AUP.

3.3 Custom Hard Limits. Customers may configure additional persona-specific hard limits (e.g., "no political content", "no roleplay involving family members"). These supplement, but do not replace, Velvr's default hard limits in Section 2.


4. AI Auto-Reply Feature — Specific Rules

4.1. The AI Auto-Reply Feature is a tool to assist your business operations. You remain solely responsible for the content sent under your persona identity, including AI-generated content.

4.2. AI Auto-Reply is enabled per persona via a master switch (off by default, with a one-time acknowledgment) and can be muted per conversation. You remain responsible for every message sent under your persona, including AI-generated content. You shall not use prompts, persona configurations, or technical workarounds to bypass the master-switch acknowledgment, the per-conversation controls, or the validator pipeline.

4.3. The Service's Disclosure Validator (Layer 6) automatically ensures the first AI-generated reply in each new conversation contains an AI-disclosure marker. You shall not configure prompts, persona descriptions, or technical workarounds intended to suppress or evade this disclosure.

4.4. You shall not use the Composer Feature's AI suggestions to send content that violates this AUP, even with manual review.


5. Compliance with Fanvue Terms

5.1. Your use of the Service in conjunction with Fanvue must comply with the Fanvue Terms of Service, Acceptable Use Policy, Community Guidelines, and API Access and Usage Policy.

5.2. Violations of Fanvue's policies may result in: (a) Fanvue terminating your Fanvue account; (b) Velvr terminating your Velvr account; (c) reporting to Fanvue if Velvr becomes aware of material violations.

5.3. 18 U.S.C. §2257 Records. Velvr is software infrastructure and does not host the underlying adult content. §2257 record-keeping obligations remain with you as the producer of content and with Fanvue as the content host. Velvr does not maintain §2257 records on your behalf.


6. Enforcement

6.1 Detection Mechanisms

Velvr employs:

  • Validator Pipeline (6 Layers) — automatic mechanical safeguards on every AI-generated reply, including the Hard Limits Validator (Layer 5)
  • Random Sample Audit — 1% random sampling of AI replies for quality and compliance monitoring
  • Anomaly Detection — automated alerts for engine-health and behavioral anomalies
  • Customer Reports — fans, third-parties, and regulators may report concerns to abuse@velvr.app

6.2 Velvr's Rights

Velvr reserves the right to:

(a) Investigate any actual or suspected AUP violation; (b) Suspend account access during investigation; (c) Terminate accounts for material or repeated violations; (d) Retain Encrypted Backups of investigated data under Legal Hold (DPA Section 10.3); (e) Withhold Funds during investigation of suspected serious violations; (f) Report to Authorities as required by law (especially for CSAM, human trafficking, or other serious violations); (g) Pursue Indemnification under the Terms of Service §6.4.

6.3 Appeal Process

Customers whose accounts are suspended may appeal in writing to legal@velvr.app within 14 days of suspension. Velvr will review appeals in good faith but retains final discretion on enforcement decisions.

6.4 Permanent Bans

The following conduct results in permanent, non-appealable account termination:

(a) CSAM creation, distribution, or facilitation; (b) Confirmed identity fraud; (c) Engaging in human trafficking or sex trafficking; (d) Operating multiple accounts to circumvent prior termination; (e) Threats or harassment against Velvr employees.


7. Modifications to This AUP

Velvr may update this AUP from time to time. Material changes will be communicated with reasonable notice. Continued use of the Service after modifications constitutes acceptance.

For material changes that affect customer-facing obligations or rights (especially expansion of prohibited conduct), Velvr will provide affirmative re-acceptance via the Service.
